Terms of Service

Effective date: October 10, 2026.

These Terms cover your use of DAEMONS: the website at daemons.art and its subdomains (including the Underworld app and docs), the DAEMONS Discord bot, and the DAEMONS NFT collection on the Base blockchain (together, the "Services"). "DAEMONS", "we" and "us" mean the DAEMONS project. By using the Services, you agree to these Terms. If you don't agree, please don't use them.

1. What DAEMONS is

DAEMONS is a planned collection of 10,000 pixel-art characters on Base. The Underworld app currently runs on the Base Sepolia testnet. Testnet DAEMONS, Embers and test ETH have no real-world value and are not mainnet NFTs. Joining a waitlist or updates list does not buy, reserve or guarantee a DAEMON. No mint, mint date or price is promised. Features, settings and plans may change or never ship.

2. Not financial advice; no guarantee of value

Nothing we publish (on the website, in Discord, on X or anywhere else) is financial, investment, legal or tax advice. DAEMONS are digital collectibles, not investments. We make no promise that any NFT, in-app item or Ember will have or keep any value, be resellable, or be supported forever. Prices of crypto assets can go to zero. Only spend what you can afford to lose, and check the laws that apply to you.

3. Your wallet is your responsibility

You connect your own wallet and sign your own transactions. We never ask for your seed phrase or private keys, and we can't access, recover or reverse anything in your wallet. Blockchain transactions are final. You are responsible for checking every transaction (including price and gas) before you approve it, keeping your wallet secure, and any taxes you owe. Actions like burning a DAEMON are permanent. We are not responsible for losses caused by lost keys, phishing, scams, wrong addresses, smart contract or network failures, or third-party wallets, marketplaces or services.

4. Art and intellectual property

The DAEMONS name, logos, artwork, characters, website and code belong to DAEMONS unless stated otherwise. Owning a DAEMON NFT gives you ownership of that token on the blockchain. It does not transfer copyright or trademark rights. Unless we publish a separate license, you may display your own DAEMON for personal, non-commercial use. Art you create with our tools (for example in Paint or Dark Room) is yours to share, but you give us a non-exclusive, worldwide, royalty-free license to display it within the Services and to promote DAEMONS. Don't use our name or art in a way that suggests we endorse you.

5. Acceptable use

When using the website, the app or the DAEMONS Discord bot, you agree not to:

• break the law, or harass, threaten, impersonate or scam anyone;
• post hateful, sexually explicit involving minors, or otherwise illegal content;
• spam, phish, share malicious links, or abuse the bot (for example, flooding commands or filing false reports);
• try to hack, overload, reverse-engineer or get around security, verification or rate limits;
• use bots or scripts to game waitlists, mints or other features;
• break Discord's Terms of Service and Community Guidelines.

We may remove content, deny access, or remove roles, mute, kick or ban anyone in our Discord server who breaks these rules, at our discretion.

6. The DAEMONS Discord bot

The bot helps run the DAEMONS Discord server: member verification, form/role selection, welcome messages, help requests, and private scam reports to the team (/report). Your use of Discord is also governed by Discord's own terms. The bot is provided as is and may be offline, changed or removed at any time. How the bot handles data is explained in our Privacy Policy.

7. Third-party services

The Services rely on third parties such as Discord, X, the Base network, wallet providers and marketplaces. We don't control them and aren't responsible for them. Their own terms apply.

8. No warranties

The Services are provided "as is" and "as available", without warranties of any kind, express or implied, including fitness for a particular purpose, availability, accuracy or freedom from bugs. Smart contracts and testnet features are experimental.

9. Limitation of liability

To the fullest extent the law allows, DAEMONS and its founders, team and contributors are not liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, data, tokens, NFTs or other digital assets, arising from your use of (or inability to use) the Services. Where liability can't be excluded, our total liability is limited to the greater of the amount you paid us directly in the 12 months before the claim or USD 100. Some places don't allow these limits, so they may not fully apply to you.

10. Indemnity

You agree to cover us for claims and costs arising from your misuse of the Services or your breach of these Terms.

11. Changes and termination

We may update these Terms at any time. We'll change the "Last updated" date above, and big changes will be announced on X or Discord. Continuing to use the Services means you accept the updated Terms. We may suspend or end access to any part of the Services at any time.
